What's Peek-A-Boob?

The basic explanation is that, as sometimes-antique-dealers, we've acquired a number of magazines that contain nude pictures, and we would like to sell them.

The Problem With eBay
We tried to sell them on eBay, but if you're shopping for this kind of magazine you probably already know the problem we ran into. eBay's anti-nudity rules are quite strict; nothing overtly nude -- sexual nature doesn't matter -- unless it's in the "Adult" category. Oh, and unless it's a Playboy or Penthouse from a certain period. Or if it's a R-rated movie; those are generally fine. However, nude art books, nudist magazines, and other 'nude' content, according to eBay, belongs along side XXX porn, dildoes, and bondage equipment in the Adult area. Now, we don't have a problem with XXX porn, sex toys, or anything else that floats your boat, but if you're shopping in the Dildo And Porn area of eBay, you're not shopping for a 1950s woman lying on a bearskin rug. Selling these magazines in the Adult area would sexualize them and possibly make them illegal, but selling them in any other eBay category violates the rules. Our eBay account even got suspended for 30 days because we tried more than once to create a listing fitting eBay's fuzzy rules. Trying to fit the rules doesn't count -- a violation was a violation, and we got the boot.

Nude Versus Pornography
It's another fuzzy line: what's pornographic, and what's artistic? The famous line says that you know it when you see it. So, even though a number of our items, such as the art, weightlifting, and nudist magazines, are not pornographic by general standards, this site is still considered 'adult' in nature because nude images are not appropriate for children. Defining the magazines as 'adult' does not mean we are selling all of these magazines for sexual purposes. Many have no sexual content at all, and we are not implying that all content here is pornographic in nature. Categories devoted to pornographic content are described as such, and are separate from non-pornographic magazines.

Children In Nudist Magazines
The rule, 18 U.S.C. § 2256, says,

“[C]hild pornography” means any visual depiction, including any photograph, film, video, picture, or computer or computer-generated image or picture, whether made or produced by electronic, mechanical, or other means, of sexually explicit conduct, where—
(A) the production of such visual depiction involves the use of a minor engaging in sexually explicit conduct;
(B) such visual depiction is, or appears to be, of a minor engaging in sexually explicit conduct;
(C) such visual depiction has been created, adapted, or modified to appear that an identifiable minor is engaging in sexually explicit conduct; or
(D) such visual depiction is advertised, promoted, presented, described, or distributed in such a manner that conveys the impression that the material is or contains a visual depiction of a minor engaging in sexually explicit conduct..."
The nudist magazines for sale are investigated for any sexually explicit content -- even if children aren't directly involved -- and will not be sold or listed here if anything explicit is found. We also do our best not to post pictures of any nude children in the descriptions of magazines. The nudist magazines are being sold as historical and artistic items, akin to child nudity in National Geographic magazine, and no sexual implication is intended. The position of this site, based on national and state laws, is that the nude human form does not equate pornography, and there is nothing illegal about selling non-sexualized nude photos. As you may note, the reason we did not sell these magazines in the Adult are on eBay is because we will not equate these magazines with pornographic movies, sex toys, or sexual paraphernalia.

Sexual Nature Of This Site
This site features products we have for sale, with thorough (and hopefully entertaining) descriptions of each product. This is not a porn site, and has not been created for sexual gratification of the viewer. Some content may be sexually titillating, but overall these magazines do not constitute hard-core pornography, and some are still being sold today to consenting, happy adults at a store near you. In many cases, a modern copy of Maxim is far more sexually explicit than a 1950s girlie magazine; we have both for sale, and consider neither suitable for children, but we consider neither magazine pornographic. Due to the sexual content of some magazines, such as Playboy, Penthouse, or Hustler, we do not sell any products to minors, nor outside of North America due to stringent laws in various other countries.

2257 Statement
All models, actors, actresses and other persons that appear in any visual depiction of actual sexually explicit conduct appearing or otherwise contained in this Website were over the age of eighteen years at the time of the creation of such depictions.

All other visual depictions displayed on this Website are exempt from the provision of 18 U.S.C. section 2257 and 28 C.F.R. 75 because said visual depictions do not consist of depictions of conduct as specifically listed in 18 U.S.C section 2256 (2) (A) through (D), but are merely depictions of non-sexually explicit nudity, or are depictions of simulated sexual conduct, or are otherwise exempt because the visual depictions were created prior to July 3, 1995.
